1. Agreement to Terms These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Made By Mary, Mosaics & More (“we,” “us,” or “our”), concerning your access to and use of the MadeByMary.org website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not access or use the Site.

2. Intellectual Property Rights All content on the Site, including but not limited to artwork, images, designs, text, graphics, logos, and digital files (collectively, the “Content”), is owned by us or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to view and access the Content for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any Content without our prior written consent, except as expressly permitted (e.g., downloading a purchased digital file for personal use only).

Purchasing a physical artwork or print does not transfer copyright ownership. Copyright remains with the artist unless explicitly stated otherwise in a separate written agreement. Digital downloads are licensed for personal use only unless a commercial license is purchased.

3. User Representations By using the Site, you represent and warrant that:

You have the legal capacity and agree to comply with these Terms.
All information you provide is accurate and complete.
Your use of the Site will not violate any applicable law or regulation.

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms.
Copy, scrape, or extract Content without permission.
Upload or transmit viruses, harmful code, or disruptive material.
Harass, threaten, or impersonate others.
Attempt to circumvent any security features of the Site.

4. Purchases and Payments We may offer artwork, prints, digital downloads, commissions, or other products/services for sale on the Site. All prices are in [USD] and subject to change without notice.

Payment: Our payment methods are processed through secure third-party providers. You agree to provide accurate billing information.
Taxes: As a seller based in Washington State, we collect and remit applicable Washington retail sales tax (including on digital products) on taxable sales to Washington customers. For customers outside Washington, you may be responsible for any applicable use, sales, or other taxes in your jurisdiction. Taxes will be calculated and added at checkout where required.
Shipping: Shipping costs and estimated delivery times will be shown during purchase. We are not responsible for delays caused by shipping carriers or customs.
Risk of Loss: Title and risk of loss for physical items pass to you upon shipment.
Digital Products: Access to digital downloads is provided immediately after payment confirmation. Files are for personal use only. Due to the nature of digital products, all digital sales are final and non-refundable once accessed or downloaded.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud or errors in pricing.

5. Commissions and Custom Work (if applicable) If you request custom or commissioned artwork:

A separate commission agreement or confirmation email will outline scope, timeline, revisions, pricing, and rights.
Deposits are generally non-refundable once work begins.
We retain all copyright unless a full transfer is agreed in writing.
Revisions are limited to [e.g., X rounds] unless otherwise specified. Additional changes may incur fees.

6. Refunds, Returns, and Cancellations Our return and refund policy is as follows

Physical Artwork/Prints: Returns are accepted within 14 days of delivery if the item is unused, in original condition, and returned at your expense (shipping costs are non-refundable). Custom or commissioned pieces are generally non-refundable. Refunds will be issued to the original payment method minus any applicable fees. We do not accept returns for change of mind after the stated period or for items that have been altered.
Defective or Misrepresented Items: If an item is defective or not as described, contact us promptly. We will address valid claims in accordance with Washington consumer protection laws.
Digital Downloads and Commissions: All sales are final and non-refundable once the file is accessed/downloaded or once work on a commission has begun, except as required by law.

We do not offer refunds for change of mind after work has commenced. Contact us at madebymarymosaics@outlook.com for any issues. Clear disclosure of this policy is provided at the point of sale.

7. Disclaimers and Limitation of Liability The Site and all Content are provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by Washington law and the Uniform Commercial Code (RCW 62A), we disclaim all implied warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

For consumer goods sold primarily for personal, family, or household use, any disclaimer of implied warranties is limited to the specific qualities and characteristics expressly set forth or excluded in these Terms or the product description (e.g., variations in color due to monitor settings, printing processes, or the handmade nature of artwork).

We do not warrant that the Site will be error-free, secure, or uninterrupted. Artwork colors and details may vary slightly from images shown.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, purchases, or any Content. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Indemnification You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your use of the Site, or any content you post or transmit.

9. Termination We reserve the right to terminate or suspend your access to the Site at any time, without notice, for any reason, including breach of these Terms.

10. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in King County, Washington. You consent to the personal jurisdiction of such courts.

11. Changes to These Terms We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on the Site and updating the “Last Updated” date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
